Anthropic refused to strip Claude’s guardrails against fully autonomous weapons and mass surveillance of Americans. The Pentagon’s answer in February: designate the company a “supply chain risk” — the first American company ever hit with that label — and bar every defense contractor from doing business with it. This week, federal judge Rita F. Lin struck the whole thing down.
What the 59-page ruling says
Lin ruled the designation was retaliation against Anthropic’s AI safety stance (First Amendment) and was imposed without due process (Fifth Amendment). Her order permanently blocks enforcement. The line everyone is quoting: “The empty invocation of national security is not a blank check to punish and retaliate against government critics.”
Why this matters beyond Anthropic
Claude was the first frontier model approved for classified networks, back in July 2025 — this fight started at the top. Every major lab is negotiating military terms right now, and until this ruling the assumption was that saying no meant commercial death. Now there’s precedent: a lab can hold its red line and win in court. That shifts leverage for OpenAI, Google, everyone. Hacker News had it at 291 points within hours.
